There is a problem in the course of the
\ntransactions: how much should the seller reveal to the buyer?<\/p>\n
The question \u201cIs it ethical to sell something to someone
\nknowing the price will eventually drop?\u201d is an ancient one\u2014but
\nits solution is no less straightforward. The debate goes back to a
\ndisagreement between two stoic philosophers, Diogenes of
\nBabylon and his student Antipater of Tarsus, who took the higher
\nmoral ground on asymmetric information and seems to match the
\nethics endorsed by this author. Not a piece from both authors is
\nextant, but we know quite a bit from secondary sources, or, in the
\ncase of Cicero, tertiary. The question was presented as follows,
\nretailed by Cicero in De Officiis. Assume a man brought a large
\nshipment of corn from Alexandria to Rhodes, at a time when corn
\nwas expensive in Rhodes because of shortage and famine.
\nSuppose that he also knew that many boats had set sail from
\nAlexandria on their way to Rhodes with similar merchandise.
\nDoes he have to inform the Rhodians? How can one act honorably
\nor dishonorably in these circumstances?<\/p>\n
Diogenes held that the seller ought to disclose as much as civil
\nlaw requires. As for Antipater, he believed that everything ought
\nto be disclosed\u2014beyond the law\u2014so that there was nothing that
\nthe seller knew that the buyer didn\u2019t know.<\/p>\n
Clearly Antipater\u2019s position is more robust\u2014robust being
\ninvariant to time, place, situation, and color of the eyes of the
\nparticipants. Take for now that<\/p>\n
The ethical is always more robust than the legal.
